Public Liability Compensation
If you have suffered personal injury in an accident that was not during the course of your work or a motor vehicle accident, you may be entitled to claim compensation under Public Liability law.
To claim compensation under Public Liability Law or Occupiers Liability, you must prove that your accident and injury was caused directly by the negligence of a third party. Public Liability and Occupier's Liability law covers:
- Slip and fall accidents on public property such as footpaths
- Slip and fall accidents in retail premises such as supermarkets or retail outlets
- Sporting injuries sustained due to faulty or defective sporting premises
- injury or illness sustained from animal attacks
- injury sustained as a result of a boat or plane accident
- Injuries sustained on residential premises
- Injury resulting from defective products such as Gym equipment or toys
Significant changes have been made to public liability laws so that proving negligence has become more difficult where people are injured as a result of an 'obvious hazard'. In addition, the federal and most state governments have now introduced limits and thresholds on what can be claimed for pain and suffering.
What can I claim compensation for under Public Liability law?
Compensation may cover:
- Medical expenses (including future costs)
- Loss of income
- Pain & suffering
- Home care
Who is liable to pay Public Liability Compensation?
The responsibility or liability lies with the person ultimately responsible for the cause of the injury - even if they were not directly involved. The term "Duty of Care" infers that an owner or manager of the premises or facility where the accident occurred needs to take every reasonably precaution to prevent these types of accidents. A simple example of this is on a construction site whereby the site is securely locked up and warning signs are displayed in every possible entry location. If this duty of care is not adequately accommodated, then it is likely that the owner or occupier wcan be held liable under public liability.
What should I do if I think I have a Public Liability claim?
- Seek medical attention immediately
- Keep all medical record and receipt of expenses
- Make a record (preferably with photographs of all details pertaining to the accident / incident including your injuries
- Keep records of any loss of income resulting from the accident
